Terms and Conditions – SINEHA Spices

1 – Purpose and Acceptance

These Terms and Conditions of Use and Sale (“Terms”) govern your access to the website sinehaspices.com (the “Site”) and any purchase of SINEHA Spices products (the “Products”).
By browsing the Site or placing an order you (“you”, the “User” or the “Customer”) confirm that you have read, understood and unconditionally accepted these Terms.

2 – Products and Availability

• Product descriptions, images and prices are provided for guidance only.

• Stock is limited; adding items to the basket does not guarantee availability.

• We reserve the right to limit quantities sold or withdraw any Product at any time.

3 – Prices, Currency and Taxes

• Prices are shown in Canadian dollars (CAD), exclusive of applicable taxes (GST/QST) and delivery fees.

• International orders may incur customs duties or local taxes, which are the Customer’s responsibility.

• Prices may change without notice; the price charged is the one displayed at checkout for the confirmed order.

4 – Orders and Payment

• Secure payment via Square®, Stripe®, Apple Pay® or PayPal®.

• A sale is concluded when you receive an e-mail confirmation with an order number.

• We may refuse or cancel any order (suspected fraud, manifest pricing error, out-of-stock items, etc.).

5 – Shipping

• Carrier: Canada Post or equivalent.

• Indicative delivery times:

  • Canada: 1–7 business days.

  • International: 7–21 business days.

• Risk of loss or damage passes to you when the parcel is handed to the carrier.

• Incorrect address: reshipping costs are borne by the Customer.

6 – Returns, Exchanges and Refunds

• Cooling-off period: 14 days from receipt (Products must be sealed, unopened, in original condition).

• Procedure: e-mail contact@sinehaspices.com to obtain a Return Authorisation Number.

• Refund issued within 10 business days of inspection, excluding original shipping fees.

• Open food Products are non-returnable and non-refundable unless covered by statutory hidden-defects warranties.

7 – User Accounts

• You must provide accurate information, keep your password confidential and report any unauthorised use.

• SINEHA Spices may suspend or delete any account that breaches these Terms or the law.

8 – Intellectual Property

• All trademarks, logos, text, photographs and recipes on the Site are the exclusive property of SINEHA Spices or their respective holders.

• Any unauthorised reproduction or use is prohibited without prior written consent.

9 – Promotions

• Promo codes, gift cards or contests are subject to specific conditions stated in the relevant offer.

• Promotional amounts are not redeemable for cash.

10 – Allergies and Liability

• Our Products contain only Penja pepper and the specific ingredients listed on their label.

• We do not handle nuts or soy, and our facilities process none of these allergens.

• The Customer remains responsible for checking the ingredient list and ensuring the absence of any substance to which they are allergic.

11 – Limitation of Liability

• SINEHA Spices shall not be liable for indirect, special or consequential damages arising from the use of the Site or the Products.

• Total liability, regardless of cause, is limited to the amount paid by the Customer for the order concerned.

12 – Force Majeure

Neither party shall be liable for failure to perform due to events beyond reasonable control (strike, natural disaster, pandemic, network outage, etc.).

13 – Governing Law and Jurisdiction

• These Terms are governed by the laws of the Province of Québec and the applicable federal laws of Canada.

• Any dispute shall be submitted to the competent courts of the judicial district of Montréal, unless mandatory law specifies another forum.

14 – Changes to the Terms

We may amend these Terms at any time. The version in force is the one displayed on the Site on the date of your browsing or order.
