Terms and conditions - SINEHA Spices

1 - Purpose and acceptance

The present Terms and Conditions of Use and Sale (« Conditions ») govern your access to the site sinehaspices.com (the « Website »and any purchase of SINEHA Spices products (the « Products »).
By browsing the Site or placing an order, you (« you », l’« User »or the « Customer ») confirm that you have read, understood and accepted these Terms without reservation.

2 - Products and availability

  • Product descriptions, images and prices are provided for information purposes only.
  • Stocks are limited; adding items to the basket does not guarantee their availability.
  • We reserve the right to limit the quantities sold or to withdraw any Product at any time.

3 - Prices, currency and taxes

  • Prices are quoted in Canadian dollars (CAD), excluding applicable taxes (GST/QST) and delivery charges.
  • International orders may be subject to customs duties or local taxes, to be paid by the customer.
  • Prices are subject to change without notice; the price invoiced is that displayed when the order is validated.

4 - Orders and payment

  • Secure payment via Square®, Stripe®, Apple Pay® or PayPal®.
  • The sale is concluded when you receive a confirmation e-mail with an order number.
  • We may refuse or cancel any order (suspicion of fraud, obvious pricing error, out of stock, etc.).

5 - Delivery

  • Carrier: Canada Post or equivalent.
  • Indicative lead times :
    • Canada 1 to 7 working days.
    • International 7 to 21 working days.
  • The risk of loss or damage passes to the customer as soon as the package is handed over to the carrier.
  • Incorrect address: the cost of return shipment will be borne by the Customer.

6 - Returns, Exchanges and Refunds

  • Withdrawal period 14 days from receipt (Products sealed, unopened and in perfect condition).
  • Procedure: write to contact@sinehaspices.com to obtain a Return Authorization Number.
  • Refunds made within 10 working days of inspection, excluding initial delivery charges.
  • Opened food products cannot be returned or reimbursed, except in the case of a legal guarantee against hidden defects.

7 - User accounts

  • You must provide accurate information, keep your password confidential and report any unauthorized use.
  • SINEHA Spices may suspend or terminate any account that violates these Terms or the law.

8 - Intellectual Property

  • All trademarks, logos, texts, photographs and recipes on the Site are the exclusive property of SINEHA Spices or their respective owners.
  • Any unauthorized reproduction or use is prohibited without prior written consent.

9 - Promotions

  • Promotional codes, gift cards or competitions are subject to the specific conditions specified in the offer concerned.
  • Promotional amounts are not redeemable for cash.

10 - Allergies and liability

  • Our products contain only Penja pepper and the specific ingredients indicated on the label.
  • We do not handle nuts or soybeans, and our facilities don't handle any of them.
  • The customer remains responsible for checking the list of ingredients and ensuring the absence of any allergenic substances.

11 - Limitation of liability

  • SINEHA Spices shall not be liable for any indirect, special or consequential damages in connection with the use of the Site or the Products.
  • Total liability, whatever the cause, is limited to the amount paid by the Customer for the order concerned.

12 - Force Majeure

Neither party shall be liable for any failure to perform due to an event beyond its reasonable control (strike, natural disaster, pandemic, network failure, etc.).

13 - Applicable law and jurisdiction

  • These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada.
  • Any dispute shall be submitted to the competent courts of the judicial district of Montreal, unless otherwise provided by mandatory law.

14 - Changes to the Conditions

We may modify these Conditions at any time. The version in force is the one displayed on the Site at the date of your browsing or ordering.
